Terms of Service

These Terms govern your use of ComplySmart AI (the "Service") operated by Devarajan P from India. By signing up or using the Service, you agree to these Terms.
1. Who can use the Service
The Service is intended for Chartered Accountants and tax professionals in India, and for businesses and individuals preparing responses to Indian Income Tax and GST notices. You must be 18 or older and capable of entering a binding contract under Indian law.
2. What the Service does
The Service ingests a notice PDF, runs OCR + AI analysis, retrieves relevant case-law from Indian Kanoon, and drafts a professional response for your review and editing. It is a drafting and research assistant — not a substitute for professional judgement.
3. AI-generated content
All analyses, allegations, citations, and draft responses are produced by large language models. They may contain inaccuracies. You are responsible for:
- Verifying every case law cited.
- Checking every rupee figure against the source notice.
- Making the final professional decision on what to file and how to argue it.
ComplySmart AI explicitly does not render legal advice, tax advice, audit opinions, or financial advice. Output is a draft, not a binding professional opinion.
4. Account responsibilities
- You keep your login credentials secure.
- You ensure you have authority to upload any notice or client information you submit — the assessee's consent where applicable.
- You do not upload material unrelated to the stated purpose (e.g., non-tax legal documents, personal correspondence).
5. Fees
Notice analysis is currently free. Drafting a response is priced per-notice (Income Tax ₹999 / GST ₹699) as displayed on the pricing page at the time of purchase. Fees are one-time per notice with no auto-renewal. If the draft is unusable because the AI fundamentally failed to parse the notice, contact support@complysmartai.com within 7 days for a refund.
6. Acceptable use
You agree not to:
- Use the Service to evade tax, conceal income, or commit fraud.
- Attempt to reverse-engineer the prompts or pipeline.
- Scrape the Service or use automated tooling against it without permission.
- Upload content you do not have the right to process or share.
7. Confidentiality
We treat your uploaded notices and client data as confidential. We do not share them with anyone other than the service providers needed to operate the product (see Privacy Policy). We do not train any third-party AI model on your content.
8. Intellectual property
You retain ownership of the notices and client data you upload, and of the responses you generate. We retain ownership of the platform, prompts, and codebase. Output you generate is yours to use, file, and share with your client.
9. Service availability
We aim for high availability but do not promise an uptime SLA. The Service may be temporarily unavailable due to maintenance, third-party outages (Anthropic, Supabase, Sarvam, Indian Kanoon, Razorpay), or other causes outside our control.
10. Limitation of liability
To the maximum extent permitted by law, ComplySmart AI is provided "as is". Our aggregate liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages — including any tax demand, penalty, prosecution, or professional consequence arising from a draft you chose to file.
11. Termination
You can delete your account at any time via Settings → Delete account. We may suspend or terminate an account that violates these Terms, abuses the Service, or whose payment is reversed. On termination, your data is deleted per the retention schedule in our Privacy Policy.
12. Governing law
These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.
